1. Acceptance of Terms

By accessing or using ETCH (“the Service”), operated by ETCH (“we”, “us”, “our”), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.

2. Description of Service

ETCH is a document template processing engine that enables users to generate documents by merging templates (DOCX, XLSX, PPTX, Markdown, PDF) with data via an API. The Service is available as a cloud-hosted solution and as an on-premise installation.

3. User Accounts

To access certain features, you must create an account. You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorised use

4. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose
• Attempt to gain unauthorised access to any part of the Service
• Interfere with or disrupt the integrity or performance of the Service
• Reverse engineer, decompile, or disassemble any part of the Service
• Exceed your plan's usage limits through automated or abusive means

5. Intellectual Property

Your Content: You retain all rights to the templates, data, and documents you upload or generate through the Service. We do not claim ownership of your content.

Our Service: ETCH, its software, design, and documentation are the intellectual property of ETCH and are protected by applicable laws. You may not copy, modify, or distribute any part of the Service without prior written consent.

6. Payment and Billing

Paid plans are billed in advance on a monthly or annual basis via Stripe. All fees are non-refundable except where required by law. We reserve the right to change pricing with 30 days' notice.

Free plans are subject to usage limits as described on our pricing page. Exceeding these limits may result in throttling or suspension of service until the next billing cycle.

7. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted access to the Service. We may perform scheduled maintenance with reasonable notice. We are not liable for downtime caused by factors beyond our control.

8. Limitation of Liability

To the maximum extent permitted by law, ETCH shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising from your use of the Service.

9. Termination

You may terminate your account at any time by contacting us. We may suspend or terminate your access if you violate these terms or engage in conduct that we determine is harmful to the Service or other users.

Upon termination, your right to use the Service ceases immediately. We may retain certain data as required by law or for legitimate business purposes.

10. Changes to Terms

We may update these terms from time to time. Material changes will be communicated via email or through the Service. Continued use of the Service after changes constitutes acceptance of the updated terms.
